A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The case originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.
In her order, the court pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
The court challenge center on conflicting claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.
The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This ruling represents a notable development in a complicated legal battle featuring claims of mistaken imprisonment and contested gang affiliations.
